EMAIL

The Affiliate may deliver solicited mailings to its users.  The Affiliate is solely responsible for the content of its mailings, data and transmissions. The Affiliate represents and warrants that it will not combine Fingerhut promotions with illegal or inappropriate materials including, but not limited to, materials reasonably deemed by Fingerhut to be pornographic or fraudulent.  If Fingerhut has reasonable grounds to believe that the Client is utilizing the service for unlawful purposes, Fingerhut may suspend or terminate services and payments immediately without notice to the Affiliate. 

Notwithstanding the above, Fingerhut may immediately suspend services and payments for such Affiliate, with or without written notice to Affiliate, in the event that: 

a) Fingerhut learns that some or all of the list of addresses to which the Affiliate is mailing  has been purchased or otherwise obtained from a source known to cater to known unsolicited commercial email purveyors (i.e.:  ‘spammers’); or

b) Fingerhut learns that some or all of the list being mailed to has been obtained without the explicit or implicit permission of those on the list; or 

c) Fingerhut is notified by AOL or other ISP (i.e. Yahoo!, MSN, Earthlink, United Online, or other similar organization) that Affiliate mailings have met or exceeded acceptable standards for ‘mail abuse’, whereas “mail abuse” is defined as 1 abuse complaint per 100,000 delivery attempts.   


SEARCH MARKETING – FINGERHUT TRADEMARK

The term “Fingerhut” and derivatives thereof (e.g. Fingerhutt, Finger-hut, Finger hut, etc.) alone or within a keyword phrase, shall not be allowed as a biddable keyword.  

COUPON CODES / PROMOTION CODES

It will be considered a breach of this Agreement to utilize any promotion, promotion code, coupon or other promotional opportunity that is not specifically authorized for the Affiliate Program and explicitly authorized for your use, and we reserve the right to withhold or disallow payment for violations under this section.
